Is 7OH Legal? A Plain-English Guide for 2026

Where 7-hydroxymitragynine stands legally in the US, Canada and internationally – and why checking your own jurisdiction before ordering is your responsibility.

The short answer

In the United States, 7-hydroxymitragynine is not a federally scheduled controlled substance. That means there is no national ban. However, that is very different from saying it is legal everywhere – several states and some municipalities have restricted, regulated or banned it, and more are actively legislating. In Canada and most of the rest of the world the position varies from regulated to fully prohibited.

Why the legal picture keeps moving

Kratom alkaloid products occupy an unusual space: widely available, widely used, but not FDA-approved for any purpose, and the subject of ongoing regulatory attention. Regulators have expressed concern specifically because 7OH is potent at low milligram amounts and the market has grown quickly. That attention translates into a steady stream of new state-level bills, local ordinances, and import restrictions.

The practical consequence: a page like this can never be fully current. Treat it as a starting point for your own verification rather than a final answer.

How to check your own jurisdiction

  1. Search your state legislature website for “kratom”, “mitragynine” and “7-hydroxymitragynine”. Bills are public and searchable.
  2. Check your state health department or board of pharmacy, which often publishes consumer guidance on kratom products.
  3. Check your county and city ordinances. Local bans exist and are easy to miss.

Common patterns in US state law

Rather than publish a state-by-state list that will be out of date within months, here are the patterns to look for:

  • Unregulated. No specific statute. The product is sold openly, though it may still fall under general consumer protection or adulteration rules.
  • Age-restricted but legal. Sale permitted to adults 18 or 21 and over, with labelling and packaging requirements. This is the most common approach for kratom generally.
  • Regulated as a consumer product. Requires testing, labelling, batch documentation and prohibitions on certain additives.
  • Restricted or banned. Specific prohibitions on sale, possession or both.

Note that even “legal” states may restrict mail-order delivery or impose packaging requirements that sellers must meet.

Canada

Canada takes a stricter approach to kratom alkaloid products than most US states. Kratom has been subject to import restrictions and enforcement action, and selling it for human consumption is legally risky. We ship to Canada where permitted, but you should confirm the current position with the Canada Border Services Agency and Health Canada before ordering. Customs seizure is a real possibility, and we cannot be responsible for orders held or destroyed by border authorities.

Rest of world

The international picture is genuinely diverse. Some countries treat kratom products as a legal botanical supplement. Others classify kratom and its alkaloids as controlled or prohibited substances, and in those places importing them can carry serious penalties. A partial list of jurisdictions where these products are known to be restricted or prohibited includes parts of the European Union, the United Kingdom (following its own review of kratom), Australia, Malaysia, Thailand historically, and several Middle Eastern and Southeast Asian countries. The position in each changes.
